1. GENERAL CONDITIONS OF SALE
These General Conditions of Sale (hereinafter “General Conditions”) are drawn up in compliance with the legislative provisions of the Civil Code, Legislative Decree no. 70 of 09.04.2003 regarding information society services and electronic commerce and Legislative Decree no. 206 of 06.09.2005 (so-called Consumer Code), and, in particular, Chapter I of Title III
of Part III (articles 45 to 67), and regulate the offer and sale of products via the website
rottica.com (hereinafter the Site).
2. INTELLECTUAL PROPERTY, SOFTWARE AND CONTENTS
The contents of the Site, such as, by way of example, the works, images, photographs, dialogues, music, sounds and videos, documents, drawings, figures, logos and any other material, in any format, published on the Site, including the menus, web pages, graphics, colours, schemes, tools, characters and design of the website, diagrams, layouts, methods, processes, functions and software that are part of the Site, are protected by copyright and any other intellectual property right. Reproduction, in whole or in part, in any form, of the Site and its contents is prohibited, without the express written consent of the Manager or other holders of the relevant rights.
With regard to the use of the Site, you are only authorised to view the website and its contents. Furthermore, you are authorized to perform all other acts of reproduction
that are temporary, without any economic significance of their own, which are considered transitory or accessory, an integral and essential part of the same viewing of the Site and its contents and all other navigation operations on the website that are performed only for a legitimate use of the Site and its contents.
You are not authorized to perform any reproduction, on any medium, in whole or in part of the Site and its contents. Any act of reproduction must be, from time to time, authorized by the Manager or, where appropriate, by the authors of the individual works contained in the website or by the owners of the exploitation rights.
2.1 Acceptance of the general conditions of sale and conclusion of the contract
2.1.1 The contract stipulated between R ottica s.r.l. and the Customer (i.e. the subject, natural person,who makes the purchase on the Site, not attributable to their commercial,entrepreneurial or professional activity) must be considered concluded with the acceptance, even if only partial, of the order by R ottica s.r.l.. In the event of non-acceptanceof the order, R ottica s.r.l. will in any case promptly notify the Customer.2.2 2.1.2 By placing an order in the various ways provided, the Customer declares that he has read all the information provided to him during the purchase procedure and fully accepts these general conditions (hereinafter the "Conditions").
2.1.3 These Conditions may be printed or saved on a durable medium,in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
2.1.4 The products offered for sale by R ottica s.r.l. are only those present on the Site at the time of placing the Order, as described in the relevant information sheets.
2.1.5 In any case, it is understood that the images accompanying the description sheet of a product are for information purposes only and may not be perfectly representative of its characteristics but may differ, for example, in colour and size (also due to the browser and monitor used to access the Site and view the images).
2.1.6 To place an Order, the Customer must fill in the relevant form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and/or products that he/she intends to purchase. The Customer must also request from R Ottica s.r.l., if desired, the issuance of a tax invoice relating to the purchase, pursuant to art. 22 of Presidential Decree no. 633/19722.
2.3 1.7 Correct receipt of the Order is confirmed by R Ottica s.r.l. by means of an e-mail reply, sent to the e-mail address provided by the Customer. This confirmation message will briefly report the purchase conditions, as required by applicable law, as well as the data entered in the Order by the Customer, so that the Customer can verify the same and possibly communicate without delay any necessary corrections to incorrect data.

3. Payment methods:
Credit and prepaid cards (Paypal circuit)
You can pay using the main credit and/or prepaid cards, also using the secure Paypal circuit.
This system allows anyone who holds a credit card to purchase in a simple, fast and secure manner.
The sensitive data of the holder (name, card number, expiry date, etc.) are protected by encrypted systems so that no one will be able to gain knowledge of them in any way.
Paypal
By choosing the PayPal payment method, the customer can pay directly through his Paypal account. We reserve the right to ship the goods only to the address indicated on the account verified by Paypal. Paypal is the fast, safe and easy-to-use payment system that allows you to make purchases with maximum protection. With Paypal your information is protected. Your credit card details are never shared with online stores.
Bank Transfer
By choosing to pay by Bank Transfer, at the end of the order the customer automatically receives a confirmation email containing the bank details, after which the goods are set aside pending the arrival of the transfer in the account. The customer is required to send a copy of the payment by email within 48 hours of receiving the order confirmation. If we do not receive a copy of the payment within this period, we will cancel the order. We will ship the order when the transfer has reached our bank account.
Scalapay (starting from purchases of €100.00):
Scalapay is an innovative payment method that allows the customer to purchase in online and In Store stores, receive the products immediately and pay in installments with a monthly deadline. The service has no additional costs for the customer if the installments are paid by the due date. At the time of purchase, the first installment will be paid immediately. The subsequent ones will be charged on a monthly basis.
First installment: at the time of purchase.
Second installment: 1 month from the date of purchase.
Third installment: 2 months from the day of purchase.
Fourth installment (where available): 3 months from the day of purchase.
Scalapay is completely free for those who purchase as long as the installments are paid by the pre-established due date: in this case a small late fee will be charged (directly by scalapay). Scalapay will inform you a few days before the due date of each installment via SMS and email.
Warranty:
All the products offered are covered by the official two-year manufacturer's warranty for defects of conformity, pursuant to Legislative Decree 24/02 and more precisely pursuant to the following article:
1519-quater (Consumer rights). - The seller is liable to the consumer for any lack of conformity existing at the time of delivery of the goods. In the event of a lack of conformity, the consumer has the right to have the goods restored, free of charge, to their conformity by repair or replacement, pursuant to the third, fourth, fifth and sixth paragraphs, or to an appropriate reduction in the price or to the termination of the contract, pursuant to the seventh, eighth and ninth paragraphs.
The consumer may ask, at his choice, the seller to repair the goods or replace them, free of charge in both cases, unless the remedy requested is objectively impossible or excessively onerous compared to the other. For the purposes of the third paragraph, one of the two remedies is to be considered excessively onerous if it imposes unreasonable costs on the seller compared to the other, taking into account:
a) the value that the goods would have if there were no lack of conformity;
b) the amount; of the lack of conformity;
c) of the possibility that the alternative remedy can be carried out without significant inconvenience for the consumer.
A minor lack of conformity for which it has not been possible or it is excessively onerous to carry out the remedies of repair or replacement, does not give the right to terminate the contract.
All damages that differ from what is stated above are excluded from any type of guarantee and therefore damages caused by improper use of the purchased product are not guaranteed and the seller will not be held responsible for direct or indirect damages resulting from the aforementioned improper use.

4. Customer service:
Customer Service is available from Monday to Friday from 10.00 to 13.00 and from 17.00 to 19.00. Thursday from 10.00 to 13.00.
For any doubt or need, send an email to (info@rottica.com) specifying the reason for your request. Each of your requests, whether via chat or email, will be handled as quickly as possible, guaranteeing maximum and accurate responses and assistance.
5. Shipments:
Shipments in Italy are made via couriers (mainly GLS couriers) that operate on the national territory and are free throughout Italy.
Delivery takes place within 24/48 working hours except for the islands for which it takes at least 72 hours.
The products will leave within 24 hours of order confirmation, and will then arrive at their destination within the following two working days.
Orders placed on Friday, Saturday and Sunday will be processed on Monday and will leave on the same date.
Shipments are all traceable and after the goods are shipped the customer will receive an email or SMS with the tracking number to view the status of the shipment on the GLS website or the relevant chosen courier.
Orders placed by December 18 will be delivered in time for Christmas (in Italy) excluding the islands.
International Shipments
International shipments are made via various couriers that offer this service in the shortest possible times, depending on the different delivery destinations, which are 5/6 working days for Europe while for the rest of the world over 10 working days. The cost of shipping to Europe varies from €10.00 (Ten Euros/00) to €20.00 (Twenty Euros/00) depending on the destination country, while for the rest of the world the cost varies from €25.00 (Twenty Five Euros/00) to €40.00 (Forty Euros/00).
Orders placed after Friday, Saturday and Sunday will be processed on Monday and will leave on the same date. All shipments are traceable and after the goods have been shipped the customer will receive an email with the tracking number to follow the status of the shipment on the websites of the couriers to whom the shipment will be entrusted.
For orders from non-European countries, customs or import charges will be charged when the package reaches its destination country.
These costs are the responsibility of the recipient.
6. Exchanges and Returns:
The return request must be made within 14 days of receiving the order for orders placed from 1 December to 31 December, requests for returns or replacements must be made by 14 January).
Methods:
The replacement or return can only be made if the item received has not been used and is in perfect condition (including the original packaging intact in all its parts: external packaging, glasses case, cloth and guarantee of originality). In Italy, return shipping is free and occurs with the collection of the same by our appointed courier on a day (usually in the following 24/48) that will be communicated to the customer.
In cases where the first two collection attempts are not successful due to the absence of the customer, the relative shipment will be at your expense and with a courier chosen by the same.
The return label that will be generated by the server will be affixed directly by the courier to the package at the time of collection and therefore will not be sent to the customer. For all other countries, return shipping is at the customer's expense.
Free shipping is valid for the first replacement, further new changes of goods are at the customer's expense.
The return request must be made via email indicating the order number and subsequently filling in the return management form received via email. Once the return procedure has been started, the end customer undertakes to close the product in its original packaging where possible or in a similar one that can guarantee its integrity during transport. Upon arrival at the premises of the purchased product, it will first be checked in every part and then the refund will be issued using the same payment method used for the initial transaction.
7. PRIVACY
The personal data collected with the forwarding of the Order will be processed by R ottica s.r.l. for the sole purpose of satisfying the express requests of the Customer, in compliance with European Regulation 679/2016. Any further processing will be carried out only with the express consent of the Customer and/or for any further communications
